Adams Oshiomhole, a former governor of Edo State and former National Chairman of the All Progressives Congress, has questioned the discretionary powers exercised by judges in terrorism-related cases.
In a recent statement Channels Television, Oshiomhole expressed confusion over judicial decisions that appear to contradict explicit statutory provisions regarding terrorism convictions. He specifically referenced situations where the law clearly states that individuals convicted of terrorism “shall be sentenced to death,” yet judges impose significantly lighter sentences such as 20 years imprisonment.
The former APC chairman’s remarks highlight concerns about consistency in the application of Nigerian laws, particularly in cases involving serious offenses like terrorism. His statement suggests that judges may be overstepping their authority by imposing sentences that do not align with mandatory provisions outlined in legislation.
Oshiomhole’s comments raise important questions about judicial interpretation versus legislative intent. When a law uses the word “shall,” it typically indicates a mandatory requirement rather than a discretionary option, which makes judicial deviation from such provisions legally questionable.
The statement also reflects broader public frustration with perceived leniency in handling terrorism cases, especially given the security challenges facing the country. Oshiomhole’s questioning of judicial power underscores tensions between the judiciary and those who believe stricter enforcement of existing laws is necessary.
In Oshiomhole’s words: “I don’t understand the power judges are exercising when the law says a person convicted of terrorism ‘shall be sentenced to death,’ yet a judge sentences them to 20 years.
